JOHN SMITH, being duly sworn, deposes and says:

I am over 18 years of age, a New York licensed process server, and not a party to this action. At 3:30 P.M., on July 23, 08 at  333 East 12th Street , Suite 1234, in the County of New York, City of New York, 11211, I served the within Subpoena Duces Tecum on Company XYZ, known to me to be the Witness named herein by:

1- delivering and leaving with Jane Doe, corporation counsel, true copies thereof. Said Janie Doe is an expressly authorized agent for said Company XYZ.

Anyone NOT A PARTY to the action, who is over the age of 18, may serve the subpoena.

1-Find the person to be served.
2-Give the person a copy of the subpoena and the witness fees.
3-Fill out an affidavit of service for each person served.
4-The person on whose behalf the subpoena was served should retain this Affidavit of Service for further procedures if the person subpoenaed fails to comply with the subpoena.
